Dave Herman's wife on police chase: They Tased and arrested him for nothing


Veteran MMA heavyweight Dave Herman remains in jail after Indiana police arrested him early Tuesday morning.

Herman, 30, is being charged with resisting law enforcement with a vehicle, battery, and neglect of a dependent – all “level 6″ felonies – and resisting law enforcement, a misdemeanor, according to an incarceration sheet released by the DeKalb County Sheriff’s Department.Herman is being held without bond at the Dekalb County (Ind.) Jail. A call to the department’s sheriff was not immediately returned, but a rep from the Dekalb County prosecutor’s office said the fighter will be formally charged today.

In 2005 and 2008, Herman pled guilty to lesser charges after being charged with battery resulting in bodily injury, according to court records. A 2006 battery charge was dismissed without prejudice.

As MMAjunkie previously reported, police stated Herman’s car was speeding and had no headlights or taillights. Police attempted to stop the car, and the driver refused, leading to a three-mile chase, according to the incident report. Herman approached police aggressively after getting out of his car and was hit with a Taser gun and taken into custody.

Herman’s wife, Madeline Herman, told MMAjunkie they were traveling home to Fort Wayne, Ind., from a friend’s house, along with their newborn son, when they began experiencing car trouble. Shortly afterward, they noticed they were being followed and looked for a safe, well-lit area to pull over.

“They said it took three miles,” she said. “It seemed like a lot less to me, but if I had to guess, it was a mile, mile and a half. It wasn’t this big high-speed pursuit.”

She said Herman exited the vehicle because he didn’t want police approaching the car with guns while his child was in it. He also requested identification from the officers.

“He’s done this multiple times before, never having an issue, that he requests the identification before proceeding in any interaction with the police,” she said.

She took a video recording of the interaction (watch it above), initially filming the car’s rearview mirror. The video shows Herman requesting identification and then being ordered by an officer to turn around under the threat of being Tased. Herman turns around, putting his hands on his head, but then lowers them and is Tased.

Later, the video shows her requesting identification from the officers, who show her their badges and what appear to be police-issued IDs. Madeline Herman claims in the video she was held hostage by the officers and said they refused to let her roll up her windows to keep her son warm.

The video also appears to show officers talking about dash-cam and body-cam footage of the incident. One of the officers who pulled pver Herman’s car admits his body-cam wasn’t initially on and doubts his police car’s dash-cam was on, as well.

Madeline Herman told MMAjunkie she and her husband intend to contest the police charges.

“It’s incredibly stressful, and we were just trying to get home with our infant son, and they Tased and arrested him for nothing,” she said. “There was no crime committed. He was simply asking for identification from him, and now it escalated into this.

“Knowing Dave, we’re going all the way with this.”

Herman (22-6), a former UFC and Bellator fighter, most recently fought this past May, outpointing Kalib Starnes at Titan FC 28.
